Yes. The applicant will receive a standard confirmation of receipt of the application by post or through the e-filing system of the PVP Office (Sakpatenti).
If the variety has already undergone a DUS test in another country, sample material shall not be required. If no previous DUS test results are available, the applicant shall provide the sample material to the Georgian DUS testing authority.
The authority empowered to conduct examinations on the distinctness, uniformity, and stability (DUS) of a new plant variety is the LEPL Scientific-Research Center of Agriculture, operating under the Ministry of Environmental Protection and Agriculture of Georgia, or a person accredited in accordance with the legislation of Georgia.
When relevant, the applicant shall provide sample materials to the Georgian DUS testing authority within 2 weeks from the publication of the plant variety application in the Official Bulletin.

Currently there is no national application fee for the processing of a new plant variety application at Sakpatenti.

It is highly recommended that an applicant who does not have a permanent residence or a registered legal address in Georgia be represented by a Georgian patent attorney or another representative.

The application shall be deemed filed with Sakpatenti on the day of the submission of the following documents:
- application form;
- proposed denomination of the new plant variety;
- description of the new plant variety.

Applications may be submitted at any time. See “Plant Material” section for more information, when plant material is required.
- Where the application is filed by a representative, a document certifying the representative’s authority shall be attached to the application or filed within one month from the filing date.
- Where the application is filed by a successor in title, a document certifying the successor’s status shall be attached to the application or submitted within 1 month from the filing date.
- If the new plant variety described in the application filed with Sakpatenti has been filed in another member of the Union, the applicant shall attach to the application a certified copy of the first application and its Georgian translation.
- If the plant variety is protected in another member of the Union, a certified copy of the official documents confirming the breeder's right, issued by the competent authority of the respective country and its translation into Georgian shall be attached to the application or submitted within two months from the filing date.
- If the application filed with Sakpatenti concerns a variety for which the examination of distinctness, uniformity, and stability (DUS) has already been conducted by the competent authority of a member state of the Union, the applicant shall attach to the application a certified copy of the official document issued by that authority reflecting the results of the DUS examination, together with its Georgian translation.
- The application shall be filed in the Georgian language. If the application materials are submitted in a foreign language, the applicant shall submit a Georgian translation within three months from the filing date.
