The PVP Office requires a copy of the submitted application data in paper format (Pdf document generated after submission of application data in UPOV PRISMA).
Yes. The PVP Office will send a confirmation by e-mail.
It depends on the case:
- For the UPOV Members who have signed a Memorandum of Understanding (MOU) with Viet Nam for the exchange of DUS reports, there is no need to send plant material if a DUS report is already available.
(*As of January 2020: Japan; France; Netherlands; European Union; Republic of Korea);
- For the others, in the case where there is a need to perform a DUS examination in Viet Nam, the PVP Office will specify in a Notification, to be sent by email to the applicant and the local representative, the procedure to be followed in relation to the plant material for DUS Testing (e.g. detailed address of the National Center for DUS Testing (NCPT), timing, quantity…)
Once the application is received, the applicant will be informed about the procedure for the payment (method, amount to be paid). The information is also available on http://pvpo.mard.gov.vn/DetailInfomation.aspx?InfomationID=IN00000449/
Yes, the PVP Office will confirm after receipt of the payment of the application fee.
No, an agent or local representative in the country is not needed if you are not a resident. However, in order to facilitate for the process, the PVP Office encourages to work with an agent.

The filing date is the date in which application is received by the PVP Office (PVPO) in paper format.
The PVPO will examine the application within 5 days after receiving the application. If information or documents are missing, the PVPO will inform the applicant and will allow 30 days to complete or send the missing information, including the payment of the application fee.
The filing date will be the date when all relevant information is received including the payment of the application fee. The filing date will be notified in writing to the applicant by the PVPO.
UPOV PRISMA Disclaimer: The authority entrusted with the task of granting breeders’ rights (PBR authority) retains full responsibility in relation to the requirements concerning the filing date of applications in accordance with the legislation of the member of the Union concerned.
In the case of DUS examination conducted in Viet Nam, the applicant has to submit plant material to DUS test agencies when the application is accepted by the PVP Office.
If the applicant cannot meet the deadline (one month after publicizing for acceptance of the application), a proposal needs to be sent to the PVP Office, with relevant explanations on the reasons of the delay for submitting plant material. The proposal will be considered and the PVP Office will inform the applicant whether or not the application could be accepted.
The applicants are invited to provide, if possible, a copy of the application(s) which have already been filed in other Country(ies) or Territory(ies).
