Specific requirements in relation to UPOV PRISMA
Are there any specific requirements in relation to UPOV PRISMA that are not required when filing an application directly to the PVP Office?

No requirements have been notified by the PVP Office.

Application data
Will I receive confirmation that my application data has been received successfully?

Yes. The PVP Office will send a confirmation note via e-mail

The PVP Office requires the documents of the submitted application data in hard copy paper format with the original signature of the applicant.

Plant Material
When applicable, where should I send the plant material?

The applicant should submit the plant material to PVP Office at the same time as the application. The application number and date will be issued only when all the requirements of PVP application including plant material are fulfilled, but it depends on the type of plant material.

If plant material is vegetatively propagated, the applicant can provide a confirmation note, then has to submit plant material within the due time requested by the examiner before starting DUS growing tests.

Please download and complete the form Confirmation Note for Submitting Plant Material and send it in hard copy paper format with the original signature of the applicant.

If the applicant cannot submit the plant material within the due time, the application will be declared to be abandoned.

The quantity and quality of plant material for DUS examination should conform to the Notification No. 2022-2 of Korea Seed and Variety Service (Standards of plant material )

Payment
How and when do I pay the PVP application fee?

Details on how to make payment will be sent when notifying that the application data has been received, or you can pay the fee through account transfer under the name of applicant to below account:

  • Account No. : 132-01-327381
  • Bank : NH Nonghyup
  • Account holder : Korea Seed & Variety Service
  • PVP application fee : 38,000 Won(Korean Won)
Will I receive confirmation that the payment has been received?

The PVP Office does not notify the confirmation when the fee is paid. The PVP Office will contact the applicant when there is something to amend including PVP application fee payment via e-mail.

Agent / Local Representative
Do I need an agent or local representative in the country, if I am not a resident?

A foreigner who has neither a domicile nor a place of business in the Republic of Korea shall be represented by an agent who has an address or place of business in the Republic of Korea.

You have to contact and appoint the agent before making the application.

UPOV PRISMA Note: Agents that have already created an AGENT Account in UPOV PRISMA can indicate the territories in which they operate. Those agents will appear in a list. In cases where agents need to be accredited by the PVP Office, the agents will only be added to the list of agents available in UPOV PRISMA after the PVP Office has confirmed that the necessary accreditations have been given.
Filing Date
What is considered to be the filing date? (Note: For instance, are there any documents that the applicant must submit to the PVP offices in addition to the application form in PRISMA and the documents required in the application form in PRISMA. If so, please indicate such documents. Are there any documents that the applicant must send in paper format to the PVP Office. If so, please indicate such documents.)

The filing date will be the day all the requirements of application have arrived at the PVP Office.

The requirements of application include plant material, fee payment and application documents in accordance with Articles 30 and 32 of PVP Law (Korean | English).

Dates for submission
For testing or plant material purposes, are there dates for the submission of applications?

There are no deadlines for applications, however the application date will dictate whether or not the growing test can be conducted in current year.
