Specific requirements in relation to UPOV PRISMA
Are there any specific requirements in relation to UPOV PRISMA that are not required when filing an application directly to the PVP Office?

Yes, all attached document (cession of rights, power and declaration of novelty), must be traduced in Spanish and apostilled.

Application data
Will I receive confirmation that my application data has been received successfully?

Yes, by email (to the email indicated in UPOV PRISMA).

Plant Material
When applicable, where should I send the plant material?

Once the requirements according to national regulations have been met, the PVP Office is responsible for contacting the country where the DUS examination and shipment of plant material will be carried out (specialized institution, quantity and date of shipment of the plant material, price, bank account, telephone numbers and contact email). When the DUS examination is carried out for the first time, the plant material must be sent to the competent DUS examination center for the specific examinations to be carried out. The PVP Office will provide detailed information on how to proceed in this regard.

How and when do I pay the PVP application fee?

The payment must be made prior to the submission of application in UPOV PRISMA, by bank transfer to the following account: ?

Will I receive confirmation that the payment has been received?

Agent / Local Representative
Do I need an agent or local representative in the country, if I am not a resident?

Yes, for the entire application process, since we do not have an online management system.

UPOV PRISMA Note: Agents that have already created an AGENT Account in UPOV PRISMA can indicate the territories in which they operate. Those agents will appear in a list. In cases where agents need to be accredited by the PVP Office, the agents will only be added to the list of agents available in UPOV PRISMA after the PVP Office has confirmed that the necessary accreditations have been given.
Filing Date
What is considered to be the filing date? (Note: For instance, are there any documents that the applicant must submit to the PVP offices in addition to the application form in PRISMA and the documents required in the application form in PRISMA. If so, please indicate such documents. Are there any documents that the applicant must send in paper format to the PVP Office. If so, please indicate such documents.)

No physical documents are required to be submitted.

The filing date is determined based on the date the procedure is officially accepted at the SENADI offices in Ecuador. This is contingent upon fulfilling all the requirements stipulated by national regulations. You may consult our website/contact us to get information on the requirements. For legal purposes, the qualification date of the application corresponds to compliance with these requirements in accordance with national normative.

For testing or plant material purposes, are there dates for the submission of applications?

There are no dates, you can submit applications throughout the year. For information in relation to the submission of plant material for examination purposes see Section “Plant Material”.
