Celebration of the twentieth anniversary of the accession of China to UPOV Convention

The protection of new varieties of plants is an important part of the implementation of the national intellectual property strategy and also an important support for the development of modern seed industry.

On April 23, 1999, China joined the International Union for the Protection of New Varieties of Plants (UPOV) and formally implemented the Regulations on the Protection of New Varieties of Plants. Over the past 20 years, China has witnessed the formation and rapid development of the cause of the protection of new varieties of plants.

Twenty Years of Development - Protection of New Varieties of Plants in China

President Xi Jinping points out that we must be determined to develop China’s seed industry and accelerate the pace of cultivating excellent varieties with independent intellectual property rights, thus ensuring national food security from the source.

China has continuously improved its PVP regulatory system.

The Ministry of Agriculture and Rural Affairs, and the National Forestry and Grassland Administration are jointly responsible, for the receipt and examination of applications for rights of new varieties of plants.

Over the past 20 years, China has issued a total of 17 protected lists, covering 397 plant genera and species.

China has established a relatively complete legal and regulatory system for the protection of new varieties of plants, which conforms to both international practices and China's national situation.

Over the past 20 years, China has continuously improved its technical support system for PVP, setting up the Office for the Protection of New Varieties of Plants and the Committee for the Review of New Varieties of Plants.

The Ministry of Agriculture and Rural Affairs has established one storage center for propagation materials, 1 DUS Tests center, 27 DUS Tests Sub-centers and 3 DUS Tests Stations. 258 DUS Test Guidelines and DNA Fingerprinting Identification Protocols were released.

The National Forestry and Grassland Administration has established 1 DUS Tests Center, 2 molecular testing laboratories, 6 professional testing stations, and issued 52 Test Guidelines.

In 2018, China had ranked first in the world in terms of its annual applications for PVP for two consecutive years.

Over the past 20 years, the total amount of PVP applications received by MARA has reached 26,000, among which 12,000 have so far been granted.

By 2018, the total amount of PVP applications received by NFGA had reached 3,717, among which 1,763 have so far been granted.

A new maize variety, ZhengDan 958, has increased production by 50 billion kg and revenue by more than RMB 80 billion Yuan.

An American company received RMB 5 million yuan in compensation for protection of its rights of a hybrid corn which had suffered infringement.
