Specific requirements in relation to UPOV PRISMA
Are there any specific requirements in relation to UPOV PRISMA that are not required when filing an application directly to the PVP Office?
  • No additional requirements beyond standard PVP application documents when filing via UPOV PRISMA.
  • All UPOV PRISMA-submitted applications must mirror the requirements of direct filings (PVP Act, Sections 17-19; Regulations, Part II).
Application data
Will I receive confirmation that my application data has been received successfully?

Yes. Applicants receive:

  • UPOV PRISMA acknowledgment
  • Normal confirmation from Nigeria PVP Office within 5 working days (Regulations, Section 3(5)).
Plant Material
When applicable, where should I send the plant material?
  • Send to:

NASC Designated Testing Center Will be communicated to applicants depending on the crop. 

(Currently, the NASC is working on MOUs with Mandate National Agricultural Research Institutions with capacity to conduct DUS testing for this purpose)

  • Materials will be required to be submitted within 30 days of a written request by the DUS testing and evaluation institution (Regulations, Section 11(1).
Payment
How and when do I pay the PVP application fee?

Bank transfer to NASC account (details will be provided post-application).

Within 14 days of application submission (Regulations, First Schedule).

Will I receive confirmation that the payment has been received?

Payment receipt issued within 3 working days.

Agent / Local Representative
Do I need an agent or local representative in the country, if I am not a resident?
  • Required for non-residents (PVP Act, Section 53).
  • Agents registered in UPOV PRISMA will appear in the system’s dropdown list as indicated

 

UPOV PRISMA Note: Agents that have already created an AGENT Account in UPOV PRISMA can indicate the territories in which they operate. Those agents will appear in a list. In cases where agents need to be accredited by the PVP Office, the agents will only be added to the list of agents available in UPOV PRISMA after the PVP Office has confirmed that the necessary accreditations have been given.
Filing Date
What is considered to be the filing date? (Note: For instance, are there any documents that the applicant must submit to the PVP offices in addition to the application form in PRISMA and the documents required in the application form in PRISMA. If so, please indicate such documents. Are there any documents that the applicant must send in paper format to the PVP Office. If so, please indicate such documents.)

- Completed UPOV PRISMA application form.

- Hard copies of:

  • Priority documents (if claimed) (Regulations, Section 7).
  • Original power of attorney (for agents).
  • Allocation:

-    Filing date assigned upon receipt of complete application and fees (PVP Act, Section 20).

UPOV PRISMA Disclaimer: The authority entrusted with the task of granting breeders’ rights (PBR authority) retains full responsibility in relation to the requirements concerning the filing date of applications in accordance with the legislation of the member of the Union concerned.

For testing or plant material purposes, are there dates for the submission of applications?

No fixed deadlines, but:

  • DUS testing materials must arrive before growing seasons (varies by crop).
  • Contact PVP Office for crop-specific timelines.
Additional requirements
Are there any additional requirements?

For UPOV PRISMA applications:

  • Nigerian denomination proposal (must comply with Section 19, PVP Act).
  • English translations of non-English documents.
