Specific requirements in relation to UPOV PRISMA
Are there any specific requirements in relation to UPOV PRISMA that are not required when filing an application directly to the PVP Office?

There are three ways to submit applications for protection: 1) Directly at the PVP Office, 2) E-mail (fboschi@inase.uy rpc@inase.uy ) and 3) UPOV PRISMA. The requirements for the application for protection of the breeder's right by UPOV PRISMA are the same as the application directly at the PVP Office.

By applying at the PVP Office (INASE), e-mail (fboschi@inase.uy rpc@inase.uy ) or UPOV PRISMA the requirements are:

A) Application form for registration in the Cultivar Property Registry (www.inase.uy)

B) Description of the cultivar

C) Legal power, with all formalities in paper (if necessary)

D) Reference seed sample

The PVP Office (INASE) only accepts legal powers and authorizations in paper format with all the formalities required in Uruguay; Applications presented by UPOV PRISMA in PDF are accepted by INASE.

For foreign/non-resident applicants, they must present a legal power or authorization to the Uruguayan representative to act on their behalf, with all the formalities. The authorization or legal power must be legalized and if there is a transfer of the breeder's right, it must also meet the formal requirements. The Public Notary must certify the signatures. If the power of attorney is not in Spanish, it must be translated or approved by a public translator from Uruguay. After legalization and translation, the power of attorney must be notarized in Uruguay, the notarization is carried out by a Notary in Uruguay and a Testimony of the same made by the Notary of Uruguay in paper format must be sent to INASE.

The forms must be submitted in PDF format through UPOV PRISMA and should be signed by both the legal representative and, where necessary, the agronomist engineer.

Application data
Will I receive confirmation that my application data has been received successfully?

Yes. Receipt of documents is acknowledged after review and, if necessary, complementary data or further information are requested.

Plant Material
When applicable, where should I send the plant material?

Plant material (including seeds) should be sent to the below address:

The material to be submitted, in accordance with the PVP procedure, can be:

1 - Seeds, the reference sample of seeds must be delivered together with the PBR application. However, at the request of the applicant, with a convincing justification, it is possible to accept that the sample would be delivered later. Therefore, it is accepted that the plant material / sample be provided after the submission of the application data.
2- Plant propagating material must be delivered when requested by the PVP Office.

Payment
How and when do I pay the PVP application fee?

Contact the PVP Office.
Payment must be done by wire transfer.

Payment is done in three steps:

  1. First payment must be done when the application data is approved.
  2. Second payment must be done when the provisory title is issued.
  3. Third payment must be done by the issuance of the Original Title.
Will I receive confirmation that the payment has been received?

Yes. The applicant will be informed once payment has been credited to INASE. An invoice and a receipt will be issued.

Agent / Local Representative
Do I need an agent or local representative in the country, if I am not a resident?

Yes, an agent/ local representative is needed. In Uruguay, an agent/local representative must be appointed, for non-resident applicants.

In Uruguay, for both resident and non-resident applicants, sponsorship by an agronomy engineer is a prerequisite before submitting any application. In Uruguay for residents and non-residents applicants, before submitting any application the sponsoring of an agronomy engineer is a requirement.

  1. The agronomist can be confirmed through UPOV PRISMA, for which, it will be requested to attach:
    a) letter from the local agent / representative informing INASE who will be his the sponsoring agronomist and,
    b) letter from the assigned agronomist accepting to be his the sponsor.
  2. The agricultural engineer must act as the technical responsible of a local agent / representative and must be graduated in Uruguay or revalidated in the country. The same agronomist can sponsor more than one agent/ local representative.
UPOV PRISMA Note: Agents that have already created an AGENT Account in UPOV PRISMA can indicate the territories in which they operate. Those agents will appear in a list. In cases where agents need to be accredited by the PVP Office, the agents will only be added to the list of agents available in UPOV PRISMA after the PVP Office has confirmed that the necessary accreditations have been given.
Filing Date
What is considered to be the filing date? (Note: For instance, are there any documents that the applicant must submit to the PVP offices in addition to the application form in PRISMA and the documents required in the application form in PRISMA. If so, please indicate such documents. Are there any documents that the applicant must send in paper format to the PVP Office. If so, please indicate such documents.)

The filling date is given once the submitted application data, description of the cultivar and legal power of attorney, if necessary, have been accepted.

UPOV PRISMA Disclaimer: The authority entrusted with the task of granting breeders’ rights (PBR authority) retains full responsibility in relation to the requirements concerning the filing date of applications in accordance with the legislation of the member of the Union concerned.

Dates for submission
For testing or plant material purposes, are there dates for the submission of applications?

Applications may be submitted at any time. The appointment of an agronomist is mandatory and must be completed before the submission of any application (see Agent/ local representative section).
